Delivery Guard

Terms of service

These terms are between Marvel Labs ("we") and the merchant who installs Delivery Guard ("you"). By installing or using the app you agree to them. Shopify's own terms also apply to your use of Shopify.

The service

Delivery Guard lets your customers choose a delivery or pickup date and time slot, checks those choices at checkout against the settings you enter, and helps you manage the orders. You are responsible for your settings and for fulfilling orders on the dates customers choose. Slot limits are checked against a snapshot of your bookings, so two customers checking out at the same moment can occasionally take the last place; the app flags these orders for you.

Plans and billing

Paid plans are billed by Shopify through your Shopify invoice, every 30 days, at the price shown on the app's Plan page. You can change or cancel your plan at any time from that page; uninstalling the app cancels it.

Data processing terms

For personal data of your customers that the app processes, you are the controller and we are your processor. We:

• process it only to provide the app's features, on your instructions as given through the app's settings, and never sell it, use it for advertising or share it beyond the subprocessors below;
• keep it to the minimum the features need: order IDs and numbers, the chosen date, time slot, method and location. We don't read or store customer names, email addresses, phone numbers or payment details, and we don't store addresses;
• use these subprocessors: Railway (hosting, data encrypted in transit and at rest), Resend (alert emails to you), and Anthropic (only the text you type into "Describe your delivery days", never customer data);
• limit access to the people at Marvel Labs who run the app, and protect it in transit (HTTPS) and at rest;
• delete your shop's data when Shopify tells us you have uninstalled the app (48 hours after uninstalling), and delete a customer's bookings when Shopify passes on their erasure request;
• tell you without undue delay, and within 72 hours of becoming aware, if a security incident affects your customers' data, and help you meet your own obligations to them.

Liability

The app is provided as is. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the fees you paid for the app in the 12 months before the claim.
